1. Who provides the service
The Data API and market price tables (the "Service") are provided by DealersCloud, the parent company of GCC Car Deals ("we"), to the organisation that subscribes ("you"). These terms, together with the plan and price you choose at checkout, are the whole agreement for the Service.
2. Licence
For as long as your subscription is active, we grant you a non-exclusive, non-transferable licence to use the Service's output for your organisation's own internal business purposes, for example to settle claims, value collateral, price vehicles or decide when to remarket them. Links to third-party listings are included as evidence for your internal review. You may also share an individual result, one valuation with its comparable listings, with the parties to the specific claim, loan, lease or sale it concerns, such as a claimant, a borrower or an auditor.
3. What you may not do
Except as the licence above allows, you may not resell, publish, sublicense or redistribute the Service's output; use it to build a competing dataset or service; share your API key outside your organisation; try to get around quotas, rate limits or plan limits; or send automated requests these terms do not allow.
4. API keys
Keys are personal to your organisation and confidential. Tell us immediately if a key may have been exposed so that we can revoke and replace it. You are responsible for all use of your keys.
5. Plans, quotas and fair use
Your plan sets the markets you can query, the number of calls you can make in each market each calendar month (UTC), how far back a valuation may reach and whether the full daily table is included. Unused calls do not carry over to the next month. We may rate-limit or pause traffic that threatens the Service for other customers, and we will tell you if we do.
6. Nature of the data
Values and prices are derived from advertised asking prices on public marketplaces. They are not transaction prices and they are estimates. The Service is provided "as is", without warranty of accuracy, completeness, availability or fitness for a particular purpose. You remain responsible for every decision you make using it.
7. Third-party listings
Listings and the links to them belong to the marketplaces and sellers that publish them. We do not control them and are not responsible for their content, prices, availability or accuracy.
8. Personal data
The Service returns no personal data about sellers. Please do not send us personal data about your policyholders, claimants or customers: a make, model, year, trim, mileage and a date are all the Service needs. We handle your account details as described in our Privacy Policy.
9. Fees and billing
You pay the monthly price of your plan, shown in your market's currency and excluding VAT and any other taxes, monthly in advance. We do not charge VAT; any VAT or similar tax that applies to your purchase is for you to account for. Your subscription renews automatically each month until you cancel. If a payment fails we may suspend access until it is paid.
10. Cancellation
You may cancel at any time from your Data API dashboard. Cancelling stops the next renewal; your plan stays active until the end of the period you have paid for. Fees already paid for a period that has begun are not refunded, except where the law requires.
11. Suspension and termination
We may suspend or end your access straight away if you breach these terms, if a key is misused or if continued access would put the Service at risk, and we will tell you why. When your subscription ends you must stop using the Service; you may keep the valuations you have already relied on as records of the decisions they supported.
12. Liability
To the extent the law allows, neither of us is liable to the other for indirect or consequential loss, and our total liability arising out of or in connection with the Service is limited to the fees you paid in the 3 months before the event that gave rise to the claim. Nothing in these terms limits liability that the law does not allow to be limited.
13. Confidentiality
Each of us keeps the other's non-public information, including pricing and volumes, confidential.
14. Availability and support
We work to keep the Service available, but we do not promise uninterrupted access. A service level applies only where a signed Enterprise agreement gives one. Support is by email at hello@gcccardeals.com, and Business customers are answered first.
15. Changes
We may improve or change the Service, and we may update these terms. We will give you at least 30 days' notice of a change that materially affects you, by email or on your Data API dashboard. If you do not accept it you may cancel before it takes effect; using the Service after that date means you accept the change.
